Commercial Condo Seller, should you hire an attorney?

That is a very good question, and that is what we are talking about today. Hello, Commercial Condo Seller. So, should you hire an attorney to represent you when you are selling your Mecklenburg County, North Carolina Commercial Condo? And by Commercial Condo, I am talking about an Office Condo, Warehouse Condo, Flex/Office-Warehouse Condo, Medical Condo, or Retail Condo. So as you can see, I just commonly refer to them all as Commercial Condos, makes it a lot easier. So, if you are in Mecklenburg County, North Carolina, and you are thinking of selling your commercial condo, watch this video, because I’ve got some good, helpful information for you.

All right, cool. Let’s get going. Well, sorry. I just got to tell you this real quick. I am Jeff Taylor, commercial realtor with NorthGroup Real Estate here in Charlotte – Lake Norman area, licensed real estate agent broker, serving Charlotte since 1991. That’s a long time. Retired North Carolina State Certified General Appraiser. That’s the highest designation appraiser you could get in North Carolina. And I also have lived in Charlotte since 1968, so I know the Charlotte Mecklenburg County market. You’re dealing with an area specialist.

Okay, so should you hire an attorney to represent you when you’re selling a Mecklenburg County Commercial Condo? Yes. How about that? I mean, we could just stop right there, yes. Get a North Carolina licensed real estate attorney to represent your best interests. You say, “Okay, yes, Jeff, but why?” Why? The closing attorney, right, there’s a closing attorney, does not represent your exclusive best interests, okay? So, you do not have someone that’s solely representing you unless you hire your own attorney. Okay? Yeah. You need a licensed real estate attorney to review and make any comments, revisions, give you legal advice on a purchase slash contract, and any addenda that might be received from the buyer’s attorney, right? So you just say, “Oh they’re sending over like a standard contract. I don’t need anybody to review it. You know, Jeff, take a look at it.” Well, it doesn’t work that way. I, and most of the brokers, unless they say they are, are not also a legal attorney, so we can’t give legal advice, okay? We can’t comment on the legal document, which is the offer to purchase or an addenda. We can’t draft any of these documents. That’s a big fat no-no with the North Carolina State Real Estate Commission. So, you need to have an attorney look at this for you. And we hear this a lot. It’s like, “Okay, this is just a standard contract. I’m fine.” There’s really no standard contract that’s gonna address the specifics of your deal and your transaction, right? I mean, there’s lots of things that I’ll tell you right now, that my seller’s attorneys include specific and key verbiage to protect the seller, which is you. I mean, there’s lots of stuff that’s not in our quote unquote standard commercial contract that needs to be addressed, and the attorney, if they’re very good, will put their verbiage in there to protect you, okay? So, you need to have that. Okay, so short and sweet, I mean, there’s lots of other reasons, but I don’t want to get these videos too long and drawn out.

You just want to know, should I, should I not? What’s the deal? Yeah. Get a North Carolina licensed real estate attorney to help you for your Commercial Condo when you’re selling it.

Okay, bonus. Right? Bonus. So, if you’ve ever been watching my videos for any length of time, you know that there is always a bonus. So, what is today’s bonus, Jeff? The bonus is how much does it cost? You’re like, “Okay, fine. I’m going to hire one, but what is this going to cost me?” Okay, so for seller representation, typically it’s been my experience that the attorney fees to represent exclusive seller or a Commercial Condo in Mecklenburg County, North Carolina, 4 to $800, totally worth it. Totally worth it. I mean, have you thought of stuff like what if the buyer doesn’t close? I mean, what’s the remedy? I mean, if you’ve got a good attorney on your side they’re going to help put verbiage, stuff like that in there. I mean, it’s just stuff that they think of that you don’t think of, and it’s good to have them in your corner. Okay, cool. So, I hope you like this video.
